2. What data we collect

We do not collect personal data through the website. Contact takes place directly by phone, WhatsApp, e-mail or Instagram. Data provided through these channels (name, phone number, preferred session date) is used solely for the purpose of processing your booking (Art. 6(1)(b) GDPR).

4. Cookies and local browser storage

The site does not use cookies or local browser storage (localStorage). We do not collect any identifying data in your browser, and we do not track or profile you.

Under Art. 173(3) of the Polish Telecommunications Act, storing information strictly necessary to provide the service requested by the user does not require their consent. We do not use analytics tools that install scripts or cookies on the site (e.g. Google Analytics), marketing or tracking tools. We do, however, use Google Search Console – a tool that shows us how our website appears in Google search results. Search Console does not place any scripts or cookies on our site; it only processes data from queries made to Google as an independent controller. 5. Data recipients

Data may be shared with entities supporting our operations, such as: hosting providers, Meta Platforms Ireland Ltd. (when you contact us via WhatsApp or Instagram), Google Ireland Ltd. (Google Search Console). Some of these providers may process data outside the European Economic Area (e.g. WhatsApp, Instagram – in the United States) on the basis of Standard Contractual Clauses approved by the European Commission and the EU-US Data Privacy Framework. We do not sell personal data.

6. Retention period

Contact details provided for booking purposes are retained for the time needed to process the booking and for 12 months after completion.

This document sets out the terms of rental for eFoil equipment (Fliteboard and accessories) offered by eFoil Kołobrzeg, Kasztelańska 13, 78-100 Budzistowo, Poland. Please read these terms before booking. The full rental agreement is signed at equipment handover.

1. Requirements for the renter

• Minimum age 18 years and a valid photo ID (national ID card or passport).
• Prior experience riding an eFoil is required for full-day rental. We don't run lessons or training – if you're just starting out, choose the shorter eFoil Session, where you receive the board with a technical and safety briefing and ride on your own.
• Ability to swim.
• No medical contraindications for water sports.
• Sobriety — the use of equipment under the influence of alcohol, drugs or medication affecting psychomotor performance is prohibited.

2. Refundable deposit

Rental requires a refundable deposit of 2,500 PLN. The deposit may be paid by:

• cash at equipment handover, or
• card preauthorisation (hold), or
• bank transfer credited before handover.

The deposit is fully refunded within 48 hours of the equipment being returned in good condition. If damage is found, the deposit may be reduced by the cost of repair in line with section 6.

3. Pricing and rental duration

• Full-day rental (up to 8 hours) — price on request

Pickup and return times are agreed individually. For each commenced hour of late return we charge a fee of 100 PLN. A return delayed by more than 4 hours without prior notice is treated as a breach of contract.

4. What the rental includes

• eFoil Fliteboard (model agreed at booking)
• Fliteboard battery with charger
• Wireless remote
• Water helmet
• Life vest
• Delivery of equipment to the specified address within 10 km of Kołobrzeg town centre (outside this radius, a delivery fee is agreed individually)
• A short briefing on equipment operation and safety rules at handover

5. Permitted riding locations

The equipment may be used only in the following locations:

• Coastal Baltic waters near Kołobrzeg, in places permitted for water sports and in accordance with local regulations
• Lake Kamienica (Dargocice)
• Other bodies of water agreed with the lessor in advance and confirmed in writing

It is prohibited to use the equipment: in designated bathing zones, near swimmers, in harbours and shipping channels, in waters shallower than 1.5 m, in locations with underwater obstacles (rocks, wrecks, piers), and in stormy conditions (wind above Beaufort 5, waves above 1 m).

6. Liability for equipment

The renter bears full responsibility for the equipment from handover to return. At both handover and return we jointly take photographic documentation of the equipment's condition, which both parties confirm by signature.

Damage arising from normal use (minor scratches, signs of wear) — covered from the deposit based on the service centre's estimate, up to the value of the deposit.

Damage resulting from gross negligence or breach of these terms — the renter bears full financial responsibility regardless of the deposit amount. This applies in particular to:

• collisions with the bottom, rocks or other underwater obstacles
• battery damage (repair/replacement cost up to 15,000 PLN)
• motor or propeller damage
• use of equipment in prohibited zones or unauthorised weather conditions
• use under the influence of alcohol or other substances
• lending the equipment to third parties without the lessor's consent
• theft or loss of equipment — the renter bears full liability up to replacement value (up to 70,000 PLN)

In the event of damage or loss, we recommend reporting the incident to the lessor immediately by phone and, if necessary, to the relevant services (police, rescue services).

7. Safety

• Use of the helmet and life vest is mandatory at all times while riding.
• The renter is required to check weather conditions before each session and abstain from riding in unfavourable conditions.
• Riding alone, without a spotter on shore or from a boat, is prohibited.
• Riding after dark or in conditions of limited visibility is prohibited.
• The renter is required to comply with local regulations on water sports.

8. Booking and cancellation

• We confirm the booking after prior contact and agreement on the date.
• Cancellation 48+ hours before the rental — no charge.
• Cancellation 24–48 hours before the rental — 30% of the rental value.
• Cancellation under 24 hours or no-show — 100% of the rental value.
• In case of unfavourable weather preventing safe use of the equipment — the rental may be rescheduled at no extra cost.

9. Liability of the lessor

eFoil Kołobrzeg undertakes to deliver equipment that is fully operational, clean and ready to use. In case of a malfunction not caused by the renter, we offer a replacement with other available equipment or a refund proportional to unused rental time.

The lessor bears no liability for personal injury or property damage to the renter or third parties arising during use of the equipment, with the exception of damage arising from a documented defect of the equipment existing before the rental.

10. Final provisions

Renting the equipment constitutes acceptance of these terms. The full rental agreement, signed at equipment handover, is the superior document to these terms and contains detailed provisions regarding the specific rental.

In matters not governed by these terms, the provisions of the Polish Civil Code and the Consumer Rights Act apply.

Any disputes arising from the rental agreement the parties shall endeavour to resolve amicably. Failing agreement, the competent court shall be the court having jurisdiction over the lessor's registered office.
